In continuation of its efforts, DIABLOTEK is pleased to announce a 3 years Warranty for all DIABLOTEK Power Supply Unit (in hereafter mentioned as DIABLOTEK PSU) and all DIABLOTEK “EN” series products. Meanwhile DIABLOTEK is continuing to provide basic 1 year warranty for all the rest DIABLOTEK products. All the warranty terms are limited to those residing in 48 continental US states and Canada.

DIABLOTEK warrants the products, to be free from defects in materials and workmanship for the products as sold to the original purchaser (“PURCHASER”), subject to all the terms and conditions hereunder. This warranty is for replacement for like items only. Both advanced 3 years replacement warranty and basic 1 year warranty do not cover items out of production if the company no longer stocks them. (3 years is defined as 3 years of the product on the market. Outdated technology is not covered by 3 years warranty if the item is no longer available on the common market as a new product.) This warranty is not assignable. Third party products, such as motherboards and other system components using or interacting with the DIABLOTEK products are not covered by this warranty.

DIABLOTEK’s sole obligation under this warranty is to replace or, at its option, to repair, free of charge, all the product’s defective parts. This warranty applies only on the condition that the product has been installed, maintained, and operated under conditions of normal use and in accordance with the installation guide provided herewith. The provisions of this warranty shall not apply if, in DIABLOTEK’s sole judgment, the product has been subject to misuse or neglect, improper installation, damaged in an accident, or repaired or altered in any way that affects its performance or reliability.

WARRANTY for DIABLOTEK Products
DIABLOTEK honored the 3 years Warranty for all DIABLOTEK PSU and all DIABLOTEK “EN” series products purchased on or after September 1, 2009 in the United States, provided that the above conditions as well as the following conditions are met:

1. All DIABLOTEK PSU and DIABLOTEK “EN” series products MUST be registered within thirty (30) days of original date of purchase in order to receive the 3 years Warranty. (All products NOT registered within 30 days shall receive the Standard 1 YEAR Warranty.)
2. All DIABLOTEK products under warranty coverage MUST be accompanied by proof of purchase documentation evidencing the date of purchase (copy of original invoice/receipt). (All products NOT accompanied by copy of original invoice/receipt will be returned to PURCHASER at PURCHASER’s expense.)
3. All DIABLOTEK products requiring warranty services (repair or replacement) MUST be returned to DIABLOTEK in original packaging. (All products NOT in original packaging will be returned to PURCHASER at PURCHASER’s expense.)

Warranty coverage on DIABLOTEK products shall be VOID under the following conditions:

1. The DIABLOTEK products show evidence of the serial/part number sticker(s) being altered, removed, replaced, or defaced.
2. The DIABLOTEK products had been damaged while being installed.
3. The DIABLOTEK products had been damaged by software/hardware from a company or individual other than DIABLOTEK or by motherboard incompatibility.
4. The DIABLOTEK products had not been operated in accordance with DIABLOTEK specifications, instructions, or any technical support directions.
5. The DIABLOTEK products had been modified or damaged by overclocking, tampering, user error, accident, disaster, abuse, misuse, power application, alteration, repair, modification, a fix/replacement by a company or individual other than DIABLOTEK.

The following provisions apply to all DIABLOTEK products sent in for Return Merchandise Authorization (“RMA”) in connection with a warranty claim:

1. PURCHASER shall pay for all costs associated with shipping the product to DIABLOTEK. If shipped from outside the United States, this will include freight, duty, customs fees, and taxes. DIABLOTEK shall not be responsible for any fees charged due to brokerage fees.
2. PURCHASER shall assume the risk of loss (insurance from loss or damage) in transit and the returned products shall become the sole property of DIABLOTEK. DIABLOTEK warrants that the repaired or replaced products will be free from defects in material or workmanship.
3. DIABLOTEK shall reserve the right to inspect and verify the defectiveness of any product returned. Please shall allow 72 hours as processing time once product has been received by DIABLOTEK, and 3-5 business days for shipping of the repaired or replacement product (shipped ground to the U.S.).

This warranty is in lieu of any other warranties, either express or implied, including without limitation any warranties of merchantability or fitness for a particular purpose or title against infringement, which other warranties are expressly excluded and disclaimed. DIABLOTEK shall not be liable for loss of profits or any special, incidental, EXEMPLARY, consequential, or punitive damages which purchaser or third party may sustain, even if DIABLOTEK has been advised of the possibility of such losses or damages. In no event shall DIABLOTEK’S liability exceed the purchase price of the defective product.

PURCHASER acknowledges that the goods sold by DIABLOTEK are being used or incorporated into other products or systems, and the ultimate safety of those products or systems are the sole responsibility of PURCHASER. PURCHASER assumes all risks and liability for use of DIABLOTEK products in other products or systems. In addition, DIABLOTEK is not responsible for any archival, backup, or disaster recovery services. In no event shall DIABLOTEK be liable for any damages of any kind sustained by PURCHASER, any customer of PURCHASER, and patient, or others for any suit or claim or demand arising from or related to the exercise of professional judgment and skill, or data entered into or used with the DIABLOTEK products.

Some states do not allow the exclusion or limitation of incidental or consequential damages so these limitations may not apply to you. This warranty gives you specific legal rights and you may also have other rights which vary from state to state.

This warranty shall not be extended, altered, or varied except by a written instrument duly signed by DIABLOTEK.
